Terms and conditions checkbox at checkout: why you need one and how to add it

One small checkbox gives you proof that the customer agreed to your terms, refund policy and age rules. Here is why it matters and how to add it.

Key takeaways

  • A required checkbox records that the customer agreed to your terms before paying.
  • That consent is useful evidence in chargebacks and refund disputes.
  • EU stores selling digital content often need the customer to confirm they lose the right of withdrawal once delivery starts.
  • TnC: Terms & Conditions Checkbox adds terms, age and EU AI Act consent boxes before checkout on Shopify.

Most stores link to their terms in the footer. Very few customers read them, and a footer link does not prove that anyone agreed. A required checkbox next to the checkout button changes that: the customer must actively tick it before they can pay.

That small action gives you clear evidence of consent. When a customer disputes a charge or asks for a refund outside your policy, you can show that they accepted your terms and refund policy at the time of purchase.

When you especially need one

  • Chargebacks. Proof that the customer accepted your terms supports your response to a dispute. One merchant summed it up in their review: "Helps with chargebacks, must have."
  • Digital products in the EU. Under EU consumer rules, customers normally have 14 days to withdraw from an online purchase. For digital content, that right can end once delivery starts, but only if the customer gives express consent and acknowledges they lose the right. A dedicated checkbox is a clear way to collect that.
  • Age-restricted products. An age confirmation box makes the customer state they meet your minimum age.
  • Custom and made-to-order goods. Customers confirm they understand the item cannot be returned.
  • AI-generated content. If you sell or use AI-generated products, a consent box helps you be transparent with shoppers.

This is general information, not legal advice. Check the rules for your products and markets with a qualified adviser.

How to add a terms checkbox on Shopify

TnC: Terms & Conditions Checkbox adds a required checkbox before checkout, with no theme code to edit. You can use it for terms and conditions, age confirmation and EU AI Act consent.

  1. Install TnC from the Shopify App Store.
  2. Write the checkbox text and link it to your terms, refund policy or privacy policy.
  3. Choose where it appears in your store, close to the checkout button.
  4. Match the colours and wording to your store.
  5. Place a test order to check customers cannot continue without ticking the box.

Merchants rate TnC highly for its support. A German store needed an extra checkbox for German digital law, and the team added it and adjusted the visuals for them.

What your terms should cover

A checkbox is only as useful as the terms it points to. Make sure your terms and policies clearly cover:

  • Your refund and return policy, including time limits and condition of goods.
  • Delivery times, costs and what happens if a parcel is lost.
  • Rules for digital products, custom items and sale items.
  • How you handle personal data, in your privacy policy.
  • Your business name and contact details.

Keep the language plain. Customers are more likely to accept terms they can understand, and plain terms are easier to rely on in a dispute.

Checkbox mistakes that weaken your evidence

  • Pre-ticked boxes. A box that is already ticked does not show active consent, and under EU rules pre-ticked boxes are generally not valid consent.
  • Broken links. Check that every policy link in the checkbox text opens the right page.
  • One box for everything. Separate terms, age confirmation and marketing consent so each one is clear.
  • Hidden placement. The box should sit right next to the button the customer uses to continue.

Example: a digital pattern shop in the EU

Take a store that sells downloadable sewing patterns to customers across Europe. Without a checkbox, a customer could download a pattern, then ask for a refund within 14 days, and the store would have little to show that the customer knew the right of withdrawal ended at download.

With a required checkbox reading "I agree that delivery starts immediately and I lose my right of withdrawal once the download begins", the customer makes that choice before paying. The store keeps a record of the order, the text and the time, and refund requests become much simpler to handle. The same approach works for personalised items, where a checkbox confirms the customer understands that custom products cannot be returned.

For physical goods, the box usually links to the terms and refund policy. It takes the customer one second, and it gives the store a clear answer whenever a dispute or chargeback arrives.

Writing checkbox text that works

  • Keep it to one sentence: "I agree to the Terms & Conditions and Refund Policy."
  • Link the policy names so customers can read them in one click.
  • For digital products in the EU, state clearly that delivery starts immediately and the customer loses the right of withdrawal.
  • Use a separate checkbox for each thing you need consent for, such as terms and age.

Frequently asked questions

Where should a terms checkbox appear?

Right before the customer commits to buying, close to the checkout button, with the policy names linked so they can be read in one click.

Can a checkbox help me win chargebacks?

It gives you evidence that the customer accepted your terms and refund policy, which supports your response to a dispute. It does not guarantee the outcome.

Do I need a checkbox for digital products in the EU?

If you want the right of withdrawal to end when delivery starts, the customer must give express consent and acknowledge the loss of that right. A dedicated checkbox is a common way to collect it.

Can I add an age confirmation checkbox?

Yes. TnC supports age confirmation as well as terms and EU AI Act consent.

Can the checkbox be pre-ticked?

No. A pre-ticked box does not show active consent. The customer should tick it themselves.
